For guided tours, educational and mediation projects

1. scope

These General Terms and Conditions govern the contractual relationship between the customer and the Vereinigte Domstifter zu Merseburg und Naumburg und des Kollegiatstifts Zeitz for tourist groups at the sites in Merseburg, Naumburg and Zeitz. The customer accepts these terms and conditions when placing an order.

2. booking and conclusion of contract

The customer sends his request in writing (letter, fax, e-mail, contact form) with his desired visit date and the desired guided tour or project offer to the visitor service of the Vereinigte Domstifter or the Merseburg or Naumburg Cathedral. Booking requests for the Zeitz Abbey Library should be sent to the Visitor Service of the United Cathedral Foundations.

The order for the guided tour and/or project should be submitted to the Visitor Service in writing at least one week before the desired date. The customer will receive a written booking confirmation. With this the contract is concluded. The option to reserve a verbally requested tour, guided tour or project expires after seven days. After this period, the Visitor Service reserves the right to reschedule the appointment.

3. fees and invoicing

With the booking confirmation, the customer acknowledges the valid admission prices, guide surcharges and project costs. The audio guide is included in the admission price when purchasing a one-way ticket without a guided tour. Please note that in the event of increased demand, there may be short waiting times when borrowing the audioguides.can. All admission fees, guided tours and project costs are exempt from VAT according to § 4 No. 20a UstG. A detailed price overview can be viewed on the corresponding websites of the Vereinigte Domstifter.

Per registered tour group (from 15 paying persons), a maximum of 1 tour guide and 1 bus driver receives free admission and the possibility of free participation in the guided tour. The reduced group rate for entrance fees is valid for a minimum of 15 participants.

Per registered group of children or pupils (up to 25 persons), a maximum of 1 teacher and 1 additional accompanying person are exempt from the admission or project costs. All other accompanying persons pay the respective valid project price or the school admission price. If material is used, these costs will be charged additionally.

The maximum group size for tour groups is 25 people, from the 26th person the group must be divided. Exceeding this limit is possible in exceptional cases only after consultation with the Visitor Service. For children and school groups, the maximum group size is 25 people. If the group consists of less than 10 participants, a flat fee for 10 persons will be charged for museum educational projects. Each group must be supervised by at least one accompanying person (e.g. teacher) during the entire guided tour or project time on site.

Payment (admission and tour/activity costs) can be paid on site by cash or card, or may be paid on invoice. If paying on invoice, a voucher must be presented (declaring that the travel company is covering the relevant costs).

Invoices are sent out by the Vereinigte Domstifter at the start of the following month at the latest. When invoicing countries outside Europe an additional charge of 7.00 euros will be charged in bank fees for invoices up to 2,500.00 euros.

4. change of the number of participants and cancellation

Changes in the number of participants must be communicated in writing up to three days before the confirmed date. In the event of changes that have not been announced, there is no entitlement to a reduction or increase in the number of guided tour groups or to the reversal of reserved admission tickets.

If the number of participants on the date of the visit is higher than the number booked, the actual number of participants will be charged. If the number of participants is reduced, the Vereinigte Domstifter reserves the right to charge the tour or activity price for the number of participants originally booked (minus materials). In this event, the booking confirmed by the visitor centre shall be binding.

The booking confirmed by the visitor centre is binding in regard to your visit (date and time). We can only guarantee your visit, guided tour or activity at the confirmed time of the booking. If you are more than 15 minutes late, your claim to performance of contract shall lapse. If the guided tour or activity does not happen as a result, the customer will still be liable to pay 80% of the agreed tour fee.

The right to visit the institutions of the United Cathedral Foundations remains. Access is granted taking into account the utilization of the premises as well as events taking place. After consultation on site, the tour of the delayed group - with full payment obligation - can be shortened or extended depending on the availability of staff - for an additional charge (15.00 euros per guide, per ½ hour or part thereof). A claim to this goodwill arrangement cannot be made by the customer.

Cancellation of the contract must be made in writing. Verbal cancellation is not possible. Cancellation free of charge can be made up to five days before the confirmed date.

From four days before the booked date, a cancellation fee of 40 % of the charged project or guided tour fee (less the cost of materials) will be charged. If the cancellation of a project or guided tour takes place two days or less before the agreed date, 80 % of the agreed guided tour fee or project fee (less the cost of materials) will be charged.

If the group does not turn up at the agreed date and time despite not cancelling its appointment, the price of admission and any tour or activity will be charged in full (minus material costs).

5. safety regulations, group behavior and liability

Smoking and the consumption of drinks and food is not permitted at any of the sites of the United Cathedral Foundations of Merseburg and Naumburg and the Collegiate Abbey of Zeitz. A permit of 2.00 euros must be obtained for taking photos in the interior areas. The taking of photos and videos is permitted for private purposes only. Passing on to third parties as well as commercial use is not permitted, this requires written permission and contractual regulation by the Vereinigte Domstifter. Likewise, touching the historic building fabric and the works of art as well as the library and archive collections is strictly prohibited.

Dogs may not be brought into any of the sites of the Vereinigite Domstifter. An exception to this rule is made in the case of guide dogs for the blind or service dogs, e.g. trained police and rescue dogs.

In all locations of the United Cathedral Foundations of Merseburg and Naumburg and the Collegiate Abbey of Zeitz, guided tours, the implementation of educational and mediation projects, as well as explanatory accompaniment are generally reserved for personnel authorized by the United Cathedral Foundations.

The Vereinigte Domstifter shall only be liable in the event of a breach of contract in regard to the statutory provisions in the case of misconduct or gross negligence.

6. final provisions

Amendments and addendums to these terms and conditions require the written form. The place of jurisdiction for both contractual parties is Naumburg.

Should one of the provisions in these terms and conditions be or become ineffective, this shall not affect the validity of the remaining provisions. Where provisions do not form part of the contract or are ineffective, the content of this contract shall be based on the statutory provisions.

For the provision of premises and areas

1. scope
These terms and conditions apply to contracts for the temporary use of premises and areas of the Vereinigte Domstifter for holding events such as conferences, seminars, lectures, meetings, receptions and the like.
The general terms and conditions regulate the contractual relationship between the organizer and the Vereinigte Domstiftern zu Merseburg und Naumburg and the Kollegiatstift Zeitz (Vereinigte Domstifter) at the foundation locations Merseburg, Naumburg and Zeitz. The organizer acknowledges the terms and conditions by placing the order.
The organizer has the right to engage further service providers (for example caterers, sound engineers, musicians) to secure the event. The Vereinigte Domstifter must be informed of the contacts of the contact persons (name and telephone number) in writing at least 4 weeks before the start of the event.
 
2. booking request and contract conclusion
The organizer sends a non-binding booking request in written form (contact form on the website of the Vereinigte Domstifter | letter | fax | e-mail) with information about the organizer, event date, type of event, venue (premises, areas) etc. to: Vereinigte Domstifter, Domplatz 19, 06618 Naumburg | Fax: 03445/23 01-107 | E-Mail: info@vereinigtedomstifter.de).
A non-binding offer will first be made in writing by the Vereinigte Domstifter. The contract shall only be deemed concluded when the offer has been signed by the organizer and thereafter a written reservation confirmation has been issued by the Vereinigte Domstifter. The Vereinigte Domstifter reserve the right to set a deadline for the validity of the offer.
The reservation of event rooms and event spaces constitutes a rental relationship. Subletting and reletting is therefore not permitted without approval.
 
3. fees and invoicing
The usage fees are net prices plus the statutory value-added taxes applicable at the time the contract is performed.
The optional services listed in the offer (e.g. additional technology, tables, table linen) will be charged according to the actual expenditure or the actual use.
Packages offered by the Vereinigte Domstifter per participant will be charged with the indicated number of participants (even if fewer participants have appeared and a correction of the participants has not been made in due time). It is not possible to charge for meals and drinks that have not been used.
Invoicing by the Vereinigte Domstifter takes place after the event. Invoices are due for payment immediately upon receipt.
In the event of late payment, the Vereinigte Domstifter are entitled to charge reminder fees.
 
4. change of the number of participants, room requirements, cancellations and withdrawal
A change of the contract contents up to the complete cancellation of the contract requires the written form. A verbal cancellation is not possible.
A reduction or complete cancellation of the booked rooms or areas can be made free of charge up to 4 weeks before the confirmed date.
From 4 weeks before the booked date a cancellation fee of 50 percent will be charged.
If the cancellation is made 1 week or less before the agreed date, or if the agreed services are not used without any cancellation, 90 percent of the agreed fees will be charged.
The Vereinigte Domstifter have the right to withdraw from the fulfillment of the contract if force majeure or other unforeseeable circumstances beyond their control make the fulfillment of the contract impossible or if there is a justified assumption that the security or reputation of the Vereinigte Domstifter could be endangered by the rental. In this case, there is no claim for damages against the Vereinigte Domstifter.
 
5. safety regulations, duties and liability
The organizer is informed that he is in an important monument of German art and history and has to do everything to avoid damages. He undertakes to observe the provisions of the Monument Protection Act of the State of Saxony-Anhalt of 21.10.1991 (GVBl. LSA No. 33/1991) with special attention.
The organizer is liable for property damage and personal injury resulting from the use as well as for loss of furnishings, technology and inventory. Any damage incurred must be immediately repaired at the organizer's expense by expert restorers or specialist companies appointed by the Vereinigte Domstiftern if it can be proven that the organizer caused the damage. The organizer is also jointly and severally liable for damage caused by service providers commissioned by him.
Corresponding insurance coverage (liability and accident insurance) is assumed upon conclusion of the contract.
The organizer must commission any necessary precautions, permits and ancillary services for the proper execution of the event on his own responsibility and at his own expense. Particularly affected by this are measures for fire protection and for accident and emergency care as well as duties payable to third parties, in particular GEMA fees, artists' social insurance, entertainment tax, etc.
For the protection of the structure it is necessary that the organizer complies with the fire police regulations. Decorative materials must comply with fire regulations. The installation and attachment of objects require the approval of the Vereinigte Domstifter. Doors and fire extinguishing equipment may not be obstructed.
The use of the organizer's own electrical equipment requires the consent of the Vereinigte Domstifter. Interference or damage caused by the use of this equipment
Damage to the technical equipment of the Vereinigte Domstifter shall be borne by the organizer.
Smoking and open fires are generally prohibited in the event rooms. Smoke development leads to the automatic alarming of the rescue forces. If the emergency services are called out due to non-observance of this condition, the tenant shall bear the costs of the call-out. Smoking in the open air and setting up of candles etc. (cathedral garden and cloister, cloister courtyard) is only permitted by arrangement and with the express permission of the Vereinigte Domstifter in areas allocated for this purpose.
The Vereinigte Domstifter shall only be liable in the event of a breach of contract in regard to the statutory provisions in the case of misconduct or gross negligence.
 
6. final provisions
Amendments and addendums to these terms and conditions require the written form. The place of jurisdiction for both contractual parties is Naumburg.

For the online store

1) Establishment of the contract
The United Cathedral Foundations of Merseburg and Naumburg and the Collegiate Chapter of Zeitz, Domplatz 19, 06618 Naumburg, agree with the Buyer that the following general terms and conditions of payment and delivery are accepted as authoritative. The following terms and conditions shall apply exclusively to this and all subsequent transactions with the Buyer. Our terms and conditions shall be deemed accepted in the case of an online order when the order form is sent, in the case of an order by fax when the fax is sent, and in the case of a written order when the letter or e-mail is sent. Unless otherwise agreed in writing, our offer is subject to change without notice with regard to design, quantity, price, delivery time and delivery possibility. Delivery contracts are concluded either by the written order confirmation after the order of the buyer or by our delivery. All supplementary agreements, including those concerning the completion of the order, require a separate written confirmation from the Vereinigte Domstifter in order to be valid.
 
2) Information requirements
The customer is obliged to provide truthful information during registration. In case of false information, the United are entitled to withdraw from the contract.
The customer must ensure that the email address provided by him can be reached and that the receipt of messages is not excluded due to forwarding, shutdown or overflow of the email account.
 
3) Sales prices
The prices are exclusive of shipping costs and inclusive of the currently just valid German VAT. If there are more than 4 months between order and delivery without the seller being in default, the seller is entitled to pass on an increase in the list price to the buyer after the expiry of 4 months. Such a price increase does not require the Buyer's consent. However, the prices communicated in the order confirmation shall be decisive.
 
4. terms of payment in the domestic market
Payment of the invoice amount is made by PayPal, credit card or giro pay. Other payments, in particular payment by check or cash cannot be processed and do not release from the obligation to pay the price via one of the mentioned payment methods.
An invoice can be requested subsequently in writing at shop@vereinigtedomstifter.de.
 
5. delivery
Products are delivered exclusively by independent transport companies after receipt of payment and within the Federal Republic of Germany. All products offered are, unless clearly stated otherwise in the product description, ready for immediate shipment (delivery time up to 6 working days after receipt of order). A binding shipping date can only result from the order confirmation or other individual communication. Compensation for late delivery is excluded, unless there is gross negligence. If offered products cannot be delivered because the delivery address named by the customer is wrong or incomplete, the customer has to bear all shipping costs.
PrintAtHome, a free ticket delivery service via e-mail, is used for all online and event tickets.
 
6. cancellation
(1) There is no right of revocation with regard to tickets in accordance with § 312 g para. 2 no. 9 BGB (German Civil Code) if they are booked online or via the Infoline.
(2) Paid admission tickets and event tickets and tickets for participation in public guided tours cannot be canceled. A refund can be made exceptionally if the ticket was booked in conjunction with a group tour that was cancelled in due time. Cancellation of group tours is possible either by letter to the Visitor Service of Naumburg Cathedral Domplatz 19 in 06618 Naumburg by fax +49 (0)3445/2301134 or by e-mail to fuehrung@naumburger-dom.de. In case of cancellation up to 5 working days (receipt of mail) before the date, no fee will be charged. In this case, the invoice amount due for the cancelled service will be refunded in full. In the case of cancellation after the aforementioned deadline or in the case of non-appearance of the group on the agreed date, the full invoice amount is due. The receipt of the cancellation by the visitor service of the Naumburg Cathedral is decisive for the observance of the deadline. The customer has to provide proof of this. Cancellation of individual services of the offer is not possible in case of a reduction in the number of participants, the agreed payment is due in full.
(3) Should there be special closures of the Naumburg or Merseburg Cathedral due to adverse circumstances (e.g. pandemic) and thus the expiration of the purchased tickets, the purchase price will be refunded in full.
(4) The statutory provisions shall apply to the remaining products.
 
7. retention of title and securing of claims
The delivery remains the property of the seller until full payment has been made. In the event of seizure or other interventions by third parties in the delivery items, the orderer shall notify the seller immediately in writing. In the event of a breach of contract by the Purchaser, in particular in the event of default in payment, the Seller shall be entitled to take back the delivery items after setting a deadline and the Purchaser shall be obliged to surrender them.
 
8. design and model modification
The seller reserves the right to make design, model and color changes, provided that these changes are only minor or the changes are customary in the trade or objectively positive for the customer. The changes must be reasonable for the customer, taking into account the interests of the seller.
 
9) Cancellation costs
If the Purchaser unjustifiably withdraws from a placed order, the Seller may, without prejudice to the possibility of claiming higher actual damages, claim 10 % of the sales price for the costs incurred in processing the order and for loss of profit. The Purchaser reserves the right to prove a lesser damage.
 
10) Liability
The Vereinigte Domstifter are not liable for manufacturer's guarantees and are not liable for defects which have arisen as a result of incorrect handling or through external influence. The liability of Vereinigte Domstifter for consequential damage caused by defects is excluded. For damages arising from product liability - personal injury and property damage - liability is limited to the extent that Vereinigte Domstifter assigns claims against the manufacturer or upstream dealers to the injured party.
 
11) Data protection
Name and address of the buyer as well as all data required for the business transaction will be recorded, stored and processed in compliance with the data protection regulations. The Verbuyer guarantees that customer data will not be disclosed to unauthorized third parties. In order to be able to guarantee the highest level of security for the transmission of all personal data, Vereinigte Domstifter uses Secure Socket Layer (SSL) transmission, in which all data is encrypted and protected from access by third parties. As soon as you are asked to enter personal information, SSL encryption is automatically activated.
 
12) Agreement on jurisdiction
The place of jurisdiction shall be Naumburg, insofar as it concerns a commercial transaction on both sides. The law of the Federal Republic of Germany shall apply to all legal relationships between the Seller and the Buyer to the exclusion of the Vienna Sales Convention 1980 (CISG), even if the Buyer has its place of residence or registered office abroad.
 
12) Final provisions
Should one of these provisions be invalid, the validity of the remaining provisions shall not be affected. The ineffective clause shall be replaced by a provision which comes closest to the ineffective clause in economic terms.
